This document (hereinafter, the “Agreement”) constitutes a binding legal agreement between you (“User” or “Participant”) and JAVIEFX Mentoring Limited, a registered corporation under the laws of Jamaica (hereinafter, the “Company”), governing your access to and use of the services, courses, and content provided by the Company, including, but not limited to, the JAVIEFX Ultimate Trading Course (the “Free Course”) and the JAVIEFX 1 Month Live Trading Sessions (the “Paid Course”). By enrolling in, accessing, or utilizing the services of JAVIEFX, you explicitly acknowledge and agree to the terms set forth herein. If you do not agree to be bound by this Agreement, you are directed to cease any use of the Company’s services immediately.
Operator Information:
The services, courses, and related content provided under the JAVIEFX name are exclusively operated, managed, and delivered by JAVIEFX Mentoring Limited, a duly incorporated and registered entity in Jamaica.
1. General Disclaimer
1.1 Independent Entity
The Company operates independently and is not an agent, employee, or affiliate of any broker, including Deriv. The Company disclaims any representations, warranties, or guarantees regarding the services or performance of any third-party broker.
1.2 Educational Purpose Only
All services and courses provided by the Company are for educational and informational purposes only and are not tailored to the individual financial circumstances of any Participant. The Company does not warrant the success, profitability, or suitability of any trading strategies presented within its courses.
2. No Financial Advice
2.1 Educational and Informational Nature
The Company does not purport to provide, nor does it provide, investment, financial, legal, or other professional advice. The information, strategies, and methodologies presented in the Company’s Free and Paid Courses are strictly for educational purposes and should not be construed as personalized financial advice, investment recommendations, or trading directives.
2.2 Non-Registered Status
The Company is not a licensed financial advisor, investment advisor, broker-dealer, or fiduciary under applicable laws or regulations.
2.3 Independent Trading Decisions
Participants are solely responsible for conducting independent research, assessing their own risk tolerance, and making trading decisions without reliance on any material, content, or signals provided by the Company.
2.4 Trading Signals Disclaimer
- The Company may issue trading signals from time to time (the “Signals”), which are intended solely as educational tools to demonstrate potential trading opportunities and strategies.
- Participants expressly acknowledge and agree that the Signals:
- Do not constitute personalized trading advice or recommendations to take specific trades.
- Are not guaranteed to be issued with any regularity, frequency, or schedule, and the Company assumes no obligation to provide a particular quantity or quality of Signals.
- Participants further agree to evaluate all Signals independently, using their own judgment, and to assume full responsibility for any actions taken in reliance upon such Signals. The Company disclaims all liability for losses, missed opportunities, or other adverse consequences resulting from reliance upon or absence of Signals.
2.5 Market Risk and Hypothetical Scenarios
The financial markets involve significant risks, including the potential for total financial loss. Hypothetical scenarios presented during courses are strictly illustrative and are not indicative of actual or guaranteed results.
2.6 No Fiduciary Relationship
The provision of educational services does not create any fiduciary or advisory relationship between the Company and the Participant.
3. Strict No Refund Policy
3.1 Binding Commitment
All payments made for the Company’s Paid Courses, including JAVIEFX 1 Month Live Trading Sessions, are final, non-refundable, and non-transferrable.
3.2 Acknowledgment of Policy
By enrolling in a Paid Course, the Participant expressly acknowledges and agrees to this strict no-refund policy, regardless of the following circumstances:
- Dissatisfaction with the content, delivery, or perceived value of the course.
- Failure to attend, complete, or achieve personal trading objectives.
- Changes in personal circumstances, such as financial constraints or scheduling conflicts.
3.3 No Exceptions
Refunds will not be granted under any condition, including claims of technical difficulties, Participant error, or unrealized expectations.
3.4 Participant Responsibility
It is the sole responsibility of the Participant to evaluate the suitability of the course prior to registration.
4. Broker Relationship Disclaimer
4.1 Affiliate Relationship
Participants in the Free Course may be directed to sign up with Deriv, a broker with which the Company maintains an affiliate relationship.
4.2 No Warranties or Endorsements
The Company disclaims all liability for the actions, omissions, or services of Deriv or any other broker. Participants engage with such brokers entirely at their own risk and discretion.
5. Course Duration and Structure
5.1 Flexible Duration
The Paid Course consists of live trading sessions that may range from two weeks to one month, at the sole discretion of the Company.
5.2 Live Delivery
Content is delivered in real-time, and recordings may not be provided. Participants are responsible for attending scheduled sessions.
6. Limitation of Liability
6.1 Waiver of Liability
To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
- The use of or inability to use the Company’s services or materials.
- Financial losses incurred through trading or reliance upon Signals or educational content.
- Technical interruptions, errors, or omissions.
6.2 Indemnification
Participants agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, or liabilities arising from their participation in the Company’s services.
7. Intellectual Property
All materials, content, and methodologies provided by the Company are the sole intellectual property of JAVIEFX Mentoring Limited and are protected by copyright and other applicable intellectual property laws.
8. Amendments
The Company reserves the right to update, modify, or amend this Agreement at any time. Continued use of the Company’s services constitutes acceptance of any such modifications.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising from this Agreement shall be exclusively subject to the jurisdiction of the courts of Jamaica.
